  Appeal by the loser businessman not entertained by court

Mr. Kakavas, a Gold Coast businessman who claimed to be suffering from pathological gambling problems filed an appeal against huge loss to the tune of S20.5 million at Melbourne’s Crown Casino. However, he had bagged $1.479 billion during his 30 different visits. The businessman appealed to the court that the casino was well aware of his pathological gambling and induced him to the casino by providing a private jet, cash and investment incentives also. However, the Court of Appeal did not agree with him and upheld the Supreme Court’s earlier decision stating that the casino did not take any advantage out of his gambling habits. Justice Bongiorno maintained that Mr. Kakavas could efficiently negotiate the terms in his favor at the casino and showed his competency for the same. The worthy Justice stated that the offers made by Crown were in no way out of step. He rejected Mr. Kakavas’s claim of losing $30 million in 2006. He added that Mr. Kakavas had even bagged $ 14 million in that year. The Justice said that an overall loss on the part of the businessman is not a surprise. He added that more you play; there are more chances of loss. Mr. Kakavas was also required to pay the Crown Casino towards the legal costs.
